Terms of Service
These Terms of Service ("Terms") govern your access to and use of ProteusIQ, an AI-powered advertising creative generation service operated by Beeldify, a sole trader registered in the Netherlands ("we", "us", or "our"). By creating an account or using the service, you agree to these Terms.
1. The Service
ProteusIQ allows users to upload product images and generate advertising creatives in multiple formats using artificial intelligence. Outputs are generated by third-party AI models and may vary in quality. We do not guarantee specific creative results for any input.
2. Account
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Credits and Subscription
- Subscription pricing is displayed at checkout and on our pricing page. Prices include applicable VAT where required.
- Each subscription period grants you a fixed allocation of credits, which reset on your monthly renewal date.
- Credits are non-transferable and do not roll over to the next billing period — unused credits expire at the end of each month.
- One credit is consumed per generation job per selected format.
- Free trial credits, where offered, follow the same rules and cannot be transferred or redeemed for cash.
4. Payment and Billing
Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis. Prices shown on the pricing page are estimates based on your detected location and include an estimated local tax rate. The final price, inclusive of the applicable tax rate for your country of residence, is confirmed at checkout. Tax rates may vary by country — users outside the European Union may see different pricing or tax treatment in accordance with local regulations. We reserve the right to change pricing with at least 30 days' notice.
5. No Refund Policy
All purchases are final. Because ProteusIQ is a digital service that begins immediately upon subscription, you expressly waive your right of withdrawal under EU consumer law (Article 16(m) of Directive 2011/83/EU) at the point of purchase. No refunds will be issued for unused credits, partial billing periods, or dissatisfaction with AI-generated outputs.
6. Service Availability
We aim to keep ProteusIQ available at all times but do not guarantee uninterrupted access. The service depends on third-party providers including Google Gemini AI and Supabase. We are not liable for outages, delays, or failures caused by these providers. In the event of extended downtime caused by us, we may issue credit compensation at our discretion — this is not a contractual obligation.
7. Acceptable Use
- You may not use the service to generate content that is illegal, defamatory, or violates third-party intellectual property rights.
- You may not attempt to reverse-engineer, scrape, or abuse the platform or its API.
- You may not resell or redistribute access to the service without our written permission.
- Commercial use of generated outputs is permitted within your subscription.
8. AI-Generated Content
Outputs generated by ProteusIQ are produced by AI models and may not always accurately reproduce text, logos, or visual elements from your source image. You are responsible for reviewing all outputs before commercial use. We accept no liability for errors in AI-generated content, including but not limited to misspelled text, distorted logos, or inaccurate product representations.
9. Intellectual Property
You retain ownership of images you upload. You own the AI-generated outputs produced from your uploads, subject to the acceptable use terms above. The ProteusIQ platform, its branding, and underlying technology remain the property of Beeldify.
10. Limitation of Liability
To the maximum extent permitted by Dutch law, Beeldify is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 30 days preceding the claim.
11. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in the Netherlands.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the service after changes constitutes acceptance.
Privacy Policy
This Privacy Policy explains how Beeldify collects, uses, and protects your personal data when you use ProteusIQ. We are committed to compliance with the General Data Protection Regulation (GDPR) and the Dutch Implementation Act (UAVG).
1. Data Controller
The data controller is Beeldify, registered in the Netherlands with the Dutch Chamber of Commerce (KVK). Contact: beeldify@outlook.com
2. What We Collect
- Account data: email address, username, and password (stored encrypted via Supabase Auth).
- Profile data: username, subscription status, credit balance, account creation date.
- Usage data: generation jobs, selected formats, job status, and timestamps.
- Payment data: Stripe handles all payment processing. We do not store your card details.
- Technical data: IP address, browser type, and device information collected automatically.
- Images you upload for generation — stored temporarily and used solely to produce your requested outputs.
3. Why We Collect It
- To provide and operate the ProteusIQ service.
- To manage your account, credits, and subscription.
- To process payments via Stripe.
- To communicate service updates, billing notifications, and support.
- To improve the platform and detect abuse.
4. Third-Party Processors
- Supabase (USA/EU) — authentication, database, and file storage.
- Stripe (USA/EU) — payment processing and billing.
- Google LLC — AI image generation via the Gemini API. Uploaded images and prompts are processed by Google under their data processing terms.
- Resend — transactional email delivery.
- Hetzner (EU) — server infrastructure.
5. Data Retention
We retain your account data for as long as your account is active. Generated output images are stored for 30 days, after which they are permanently deleted. You may request deletion of your account and associated data at any time by contacting us.
6. Your Rights (GDPR)
- Right of access — you can request a copy of your personal data.
- Right to rectification — you can correct inaccurate data.
- Right to erasure — you can request deletion of your account and data.
- Right to restriction — you can request we limit processing of your data.
- Right to data portability — you can request your data in a machine-readable format.
- Right to object — you can object to processing based on legitimate interests.

7. Security
We implement appropriate technical and organisational measures to protect your personal data, including encrypted storage, access controls, and secure HTTPS connections. No system is 100% secure and we cannot guarantee absolute security.
8. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of significant changes via email. Continued use of the service constitutes acceptance of the updated policy.
